The case was based upon the idea of negligence wherein the jury ruled initially that there was negligence in regard to the ability for the hospital to provide the necessary duty of care for the patient by ensuring that they inspected the product to ensure that it wouldn't harm the patient. The initial jury could not come to the same conclusion in regard to causation, which is why the organization was not held liable for these particular issues including severable causes of action that would be negligible for the plaintiff.
