Two areas where legal concerns and court decisions may be involved relates to minors considering informed consent and confidentiality. For example, in some jurisdictions, minors may be allowed to consent to treatment without parental knowledge except in situations where it may likely cause harm to the child. Most states have child abuse reporting laws, and a counselor may be required to provide court testimony concerning issues of abuse and/or neglect (Dekraai & Sales, 1991). In essence, the law states that medical or psychotherapeutic treatment for children cannot be administered without consent to participation that is informed consent.
