According to the U.S. Equal Employment Opportunity Commission (EEOC) the American workforce is facing an "equal opportunity plague of age discrimination" (Vogel, 2009). According to the EEOC, age discrimination charges are up 30 percent since 2007.

Forced retirement based on age is one type of discrimination that exists. Kelley Drye & Warren, a New York law firm, was just ordered to pay $574,000 to a partner based on a ruling by the EEOC regarding the firm formerly requiring partners to relinquish their equity interest in the firm after the age of 70. Senior partners are now, upon court order, no longer required to retire at a set age or take less money for performing the same duties (Baxter, 2012).

Layoffs focused on older workers are another form of discrimination that exists. This is an effort to trim costs by reducing higher paid employees, focusing on a particular age cutoff. Central Freight Lines Inc was cited for behaving in this manner, by discriminating against eight workers, all over 50, who were let go because of their age.
