The Resource Conservation and Recovery Act (RCRA) is a Federal law enacted in 1976 which regulates the generation and management of hazardous wastes. It was passed amidst growing concern that improper management of wastes was posing a threat to human health. Under RCRA, the EPA dubs a broad group of wastes hazardous and thus subject to regulation. Wastes are considered hazardous if they are toxic or create a risk of fire, or if the EPA explicitly lists them as hazardous waste. The land disposal restrictions prohibit any land disposal unless the wastes is first treated to reduce or eliminate harmful constituents. Treatments which destroy hazardous constituents include incarceration. When the complete destruction of the hazardous constituents is not possible, the treatment must reduce the mobility of hazardous substances.

RCRA has been quite effective in reducing point source pollution. Non point pollution is far more difficult to regulate. It occurs when, for example, rain washes contaminants on suburban streets into storm drains. In general RCRA has been successful in mitigating solid waste disposals that damage human health. People in the US won't worry a great deal about dangerous toxins in their backyards. Certainly some laws needed to be passed to prevent toxic waste from harming people. Governmental regulations are always cumbersome, but there aren't any good alternatives.
