The major legislation responsible for providing provisions toward Emergency Medical Services was the Highway Safety Act of 1966. This legislation was responsible for transforming the EMS system in America as it allotted funding through a legislative mandate that gave authority to the U.S. Congress to improve the safety of citizens by requiring states to develop effective EMS programs. Because the Act was able to require under threat of loss of 10% of funding for highway construction funds that states greatly improve their EMS programs, states greatly improved their EMS systems resulting in the early development of advanced life support (ALS) programs.

With the passage of the 1973 Emergency Medical Services Systems Act, Congress established a definition for how states should implement their EMS systems. The main provisions of a state's EMS system entailed a requirement for states to ensure that EMS providers arranged competent personnel, facilities, and equipment capable of delivering effective and coordinated delivery of care throughout their state's communities and cities. These health care services were to be rendered under emergency conditions such as emergency calls for patient care or in the event of natural disasters. The state must register public or non-profit entities, and give them authority as well as appropriate resources that will allow these entities to provide the most effective administration of the system.
