    What are the constitutional safeguards that are associated with criminal juvenile proceedings? How do these safeguards differ/relate to the safeguards and foundations which were established for adult criminal law procedures? What would happen if adult and juvenile procedures were the same?     Juveniles are provided the constitutional rights of advance notice of the charges, the right to counsel, the right to confront and cross-examine adverse witnesses, and the right to remain silent. In addition, search and seizure protections of the Fourth Amendment to juveniles as well as Fourth Amendment requirements that a juvenile arrested without a warrant be provided a probable cause hearing are afforded to juveniles. The exclusionary rule is another protection afforded to juveniles in federal delinquency adjudications. Juveniles are entitled to Fifth Amendment protection against self-incrimination in juvenile proceedings.

    These safeguards only differ in respect to they initially weren't afforded to juveniles until the movement for Juvenile rights began in the beginning of the 20th century. These constitutional protections were always afforded to adults, but have only been afforded to juveniles over the past 100 years. Juvenile and adult procedures used to be the same, and this was disastrous for juveniles who were often convicted and sent to adult prisons where they were victimized, tortured, and molested. The courts throughout most of human history failed to distinguish between juveniles and adults at the chagrin of juveniles.
