To some degree the expert is correct, or at least to some degree. When he states that no one can "order that patient safety measures be put into effect", he is over looking the power of the Joint Commission. The Joint Commission, which governs the accreditation of any hospital that accepts government payments, dictates not only that patient safety measures be put into place, but they also tell you which measures and how to apply them. Another example is the recent determination stated by Medicare that any facility that accepts Medicare will have an electronic medical record system in place in 2012. They offer incentives for the early adopters and threaten cessation of payment for the non-adopters.
