Question: How do you build a map legend in ArcGIS without having something listed in the layers on the left?
There are two ways to put a legend on a map layout in Arcmap.
To begin, click on View menu -> Layout view.
Normally, one would have data layer(s) listed and would go to the Insert menu then click on Legend. Then work through the steps there to customize the look of it. When you finish those steps, the legend is then pasted into the layout.
Alternatively, one could build a legend on the map layout - before having any data layers listed on the left - as a template for future map designs.
