Three fundamental concepts and principles of the American legal system that particularly pertain to today's business environment are: a person is innocent until proven guilty; ignorance of the law is no excuse, and the right to free speech. To be presumed innocent is important because it puts the burden of proof on the prosecutor rather than the accused. This is not true in all countries. In America, this allows business organizations the ability to operate in a fairer environment. To be found guilty, the accused must be proven to have acted in an illegal manner and also, in addition, had bad intentions (mens rea).
