The employee was not accommodated for his disability following cancer surgery. He returned to work but needed accommodations due to a weakness in his shoulder. This was ignored by his supervisor and he was in pain. He could not afford to not work at his job.

Mr. Goods, the employee, complained of the discrimination and was subsequently fired. Under the Americans with Disabilities Act, reasonable accommodation must be given to someone with a disability. Furthermore, firing for asking for accommodation is illegal.

Mr. Goods had worked for Walmart for 12 years, including three after his surgery. The surgery severed nerves in the should and left him with limited strength in the arm. He was working under accommodations for a qualified individual. When in November of 2008 he was asked to fill in for someone on break, he said he could not because he could not do the manual lifting required.
