I would have to say that harsher penalties for nonviolent crimes are adherently equal due to the fact that they would adhere to the eighth amendment against cruel and unusual punishment. What this essentially means is that harsher penalties for nonviolent crimes adheres to the eighth amendment, as well as to the adage of letting the punishment fit the crime.
