1. From the review of the scenario presented as it relates to the case of Taxman v. Board of Education, at the time of the incident it was necessary for the school to be concerned about diversity and take steps to ensure diversity in the business department. One argument as stated by the question is that the amount of African American faculty in the school district exceeded the African American faculty in the school district however the argument of the Board of Education was that Williams was the only African American teacher in the department and 50% of the students were minorities. It was based on this argument that the school board voted to lay off Taxman. The board had focused on the school and not on the district. Based on this information, I feel that the court should decide in favor of the Board of Education. They were justified in maintaining racial diversity.
After looking up the case I find that the district court decided that there were violations of both Title VII and New Jersey statute. This judgment was also upheld by the Third Circuit Court of Appeals. The school board filed an appeal with the US Supreme Court and the case was accepted for hearing. However, a civil rights group intervened and paid compensation on behalf of the Board and the case was settled out of court. Personally, I do not agree with the court decision.
