A strike is imminent. There is an impasse. The union will not allow random drug testing and the management will not pay the entire increase in the health insurance costs.

The management will have to make sure that it adheres to the rules of the old contract. The result will be that any charges of bargaining in bad faith made to NLRB will get overruled. In other words, the pension and benefits payments will have to be made, and those workers that defy the strike will have to be paid in accordance with the old contract.

In addition, the company is in a position to absorb the erosion of 40% customer base. In addition the workers that are outside the contract will not be subject to the contract. The company is in a position to take a strike because now it has its own in-house training, drug screening, and safety programs.
