This case took place in the United States Court of Appeals for the second circuit. The Plaintiff-Appellant was, Matimak Trading Company, Ltd against the Defendants-Appellees Albert Khalily d/b/a Unitex Mills Inc and D.A.Y Kids Sportswear Inc. The plaintiff Matimak Trading Co. ltd is an organization that is under Hong Kong as it principle place of operation. The organization seeks top sue defendants Albert Khalily and D.A.Y Kids Sportswear Inc. which are two New York Corporations that are located in the Southern District due to the occurrence of the break of a contract. The Appellant invoked the court to utilize its diversity that was under 28 U.S.C 1332 (a) (2). This statement provided the fact that the jurisdiction was above the any form of civil actions that arose in the relation of a citizen of state and a citizen of a foreign state. In the year 1996, the court that was termed as Sua Sponte brought up the issue after the parties were allowed to state the problem. The complaint was dismissed in the court due to the lack proper subject matter jurisdiction.
