On the other hand an invitation to treat is an invitation to make an offer, if the person that accepts the invitation to treat makes an offer and it is accepted a contract is formed (See: Fisher v. Bell [1961] 1 Q.B. 394, [1960] 3 All E.R. 731). Similarly, an offer is made if the person making the offer has the intention to enter into a contract. On the other hand an invitation to treat takes place if the intention of the person making the invitation to treat is to start give and take discussions leading to a contract (See: Harvey v. Facey, [1893] AC 552, Also see: Spencer v. Harding (1870) LR 5 CP 561).
