Actually, transgender issues were never covered under the Civil Rights Act until a short time ago. Back in 2012, the EEOC decided that transgender persons were, in fact, covered under Title VII and that acts against transgender employees were (and still are) discriminatory. Just as an employer cannot discriminate based upon gender, race or any of the other protected characteristics, an employer also cannot discriminate based upon a person's transgender status.
