Employees are on the payroll of the company and provided a fixed salary along with bonuses as per organization's policy, along with other benefits such as medical/health insurance, etc. The employer has to withhold Federal taxes from the wages of the employee. A part of Social security as well as Medicare taxes is also withheld and matching amount needs to be paid by the employer. Under common-law rules, anyone who performs services for you is your employee if you can control what will be done and how it will be done. This is so even when you give the employee freedom of action. What matters is that you have the right to control the details of how the services are performed.

Independent contractor is not the employee of the organization and is paid as per the contractual assignment performed for the company. The general rule is that an individual is an independent contractor if you, the person for whom the services are performed, have the right to control or direct only the result of the work and not the means and methods ...
