The ethical situation that I have encountered is that in which one Afro-American employee, Emory was performing poorly because he had been transferred to your sales department and he was required to sell machine tools to a industrial buyers in an area that was white dominated. He was looked at with suspicion by his customers and the sales of your company in the areas covered by Emory fell drastically.
Your company had a policy of diversity. The dilemma is that if you report that the performance has fallen in the area because of Emory, the company policy requires that you take disciplinary action against Emory. On the other hand if you allow Emory to continue, then you would be doing a disservice to the company because the company sales will remain at a lower level. If you ask for Emory to be transferred to another areas then you will have to give reasons and the fall in sales will be held against him and his career will be hurt.
