There are several steps that are utilized for informal dispute resolution including negotiation, mediation, and arbitration. Negotiation is a technique that has proven to be the most effective informal dispute resolution technique as it enables the two parties to come to an agreeable resolution without involving outside parties. An example would be two parties that are seeking to find common ground on a fence that each side believes is encroaching on their business property, the two sides can negotiate and attempt to reach a resolution regarding the fence that is equitable for both sides.
Mediation involves going beyond negotiations wherein an outside party brings both sides together to mediate the issue and construct an acceptable resolution. In the aforementioned definition, the parties would seek to allow the mediator the ability to monitor and guide the negotiation discussions to attempt to reach the most optimal conclusion.
