This fact was observable. The reason Victim was injured was that Same beat him up and Sam would not have beaten up Victim had Sam not been given alcohol in contravention of the local law.

Tavern is not liable to victim for his injuries because of several reasons. First, there is no direct contact between Tavern and Victim. The Victim has been beaten up by Sam and not by Tavern. Further, Tavern served alcohol to Sam without knowing that Sam was intoxicated. Also, Sam beat up Victim because of the fight and quarrel between Same and Victim and Tavern had nothing to do with it. There are several witnesses that will vouch that Sam knew victim and so fought with Victim and Tavern had nothing to do with that.
