FACTS: Faragher and other female guards were subjected to sexually hostile atmosphere and that this conducts constituted discrimination in the privileges, terms and conditions of her employment.

COURT DECISION: The Court of Appeals held that the supervisors were not acting within the scope of their employment. The court concluded that the supervisors' conduct was discriminatory harassment that was sufficiently serious to constitute an abusive environment and to alter the condition of Faragher's employment.
