The difference between disparate treatment and disparate impact as they apply to employment practices are worth noting. Disparate treatment is when someone is treated differently than others within the work environment due to their protected class (US Legal, 2011). In regards to disparate impact, this means using discrimination with their protected class (HR Guide, 2011). As one can tell, they both overlap and can make a difference on whether or not a person decides to go to court over discrimination based off an employer's poor choice to discriminate against others.
