What an Affirmative Action Plan Is

According to Stanford Encyclopedia of Philosophy (2009), "Affirmative action means positive steps taken to increase the representation of women and minorities in areas of employment, education and business from which they have been historically excluded. When those steps involve 'preferential' selection - selection on the basis of race, gender, and ethnicity - affirmative action generates intense controversy (Stanford Encyclopedia of Philosophy, 2009)."

Employers Required to Have Affirmative Action Plans

In the United States, affirmative action plans are really equal opportunity employment measures that Federal, States, and local governments are required to adopt legally. Employers who engaged in contracts with federal, state, and local governments are required to develop Affirmative Action Plans. The Civil Rights Act of 1964 - Title VII - and the ADA, Americans with Disabilities Act have to do with ruling over private, State, and local governments, and schools that have over 15 employees. Any contract between a company or employer and the employee does not override any discrimination that is prohibited by Title VII, and the ADA, Title VII can override the employment environment and conditions detailed in a written employment contract between employer and employee. There is no contract or policy that overrides discrimination that is prohibited (EEOC Announces Final Bipartisan Regulations for the ADA Amendments Act, 2011).
