Illinois v. Wardlow (2000)

Facts of the Case: Police in a high crime area witnessed the plaintiff holding an opaque bag, upon him seeing the police, the plaintiff inexplicably fled the area. Because this area of Chicago was known to police to have heavy narcotics trafficking, officers gave chase and once they caught the plaintiff, he was found to be a felon in possession of a firearm.

Issue: Does someone who inexplicably flees from uniformed police in a high crime area justify this person being viewed as a suspicious subject that gives the officers probable cause to stop the person.

Results: Yes

Analysis: The Court determined that justifiable probable cause existed to allow the officer to chase the suspect under the auspice that he suspected that the accused was involved in criminal activity. Because the officer had probable cause for stopping the suspect, once he searched and patted him down to investigate further and found the gun, it was admissible in evidence at trial.

Conclusion: The suspect was convicted of his crime and the Court determined that the evasive and nervous behavior displayed by the suspect upon witnessing the police constituted justification for officers to stop him.
