Summary of the Case

The case is mainly related to the use of genetically modified organisms (GMO's), especially the genetically modified seeds for crop plantation. The case provides a prosecutor's story about law and order related to the use of GM seeds. According to the federal law, any person can carry out its business for making profits in the specified legal demarcations. The case provides the agriculture approach of Percy Schmeiser, who has a field of canola crop in Bruno. He utilizes the conventional method of farming accompanying the use of chemicals. Monsanto Inc. provides the genetically modified canola seeds to the farmers for enhancing their production (Genetically Modified Organisms).

Monsanto Inc. registered a law suit against Schmeiser for planting roundup ready canola seeds on the basis of a complaint by his neighbor, who observed him spraying roundup (herbicide) before planting the crop. The employees of Monsanto took samples from Schmeiser's land without taking his permission and executed DNA test, which provided the outcomes related to the use of Monsanto's seeds. They registered a law suit against Schmeiser for encroachment of their patent. In accordance with the patent law, the company's seeds were patented, but Schmeiser did not violate the legal rules.

On the basis of the claims from both the parties, the court did not considered Percy Schmeiser to be the victim of Monsanto and refused the bankrupting charge against him. Along with this, it was clarified that the company has the right to protect its patent. Besides this, the case also comprise of another lawsuit, which signifies the analysis of the technology used for the production of GMO's. The influence of GMO's on the ecology can be effectively analyzed through the case (Genetically Modified Organisms).
