One would advise an employer to use these agreements because it is legal and binding as with any legal dispute. For example, if the case went to court, a jury and a judge are present in order to decipher the case and the outcome of it. This is an agreement that would save both parties much time and money. In fact, most employers prefer to settle outside of a courtroom anyways because they know that if this did happen that they would get unwanted public attention, which could cause them to lose business.
