Levy and Associates installed a hidden camera in its offices after several employees complained of theft. The secret cameras were installed in the area where only female employees worked because a manager had a "feeling" that they were the ones responsible for the thefts. The surveillance cameras rotated 360 degrees and filmed office activities 24 hours a day. Employees, Mary and Joan, frequently changed their clothing in the employee locker room after their lunchtime workouts. They were upset when the video surveillance camera briefly filmed them in their underwear when the door to the locker room was opened by a co-worker. Yes, and what they did is illegal because of how they situated the camera. According to the law, no camera can be placed where there is a reasonable expectation of privacy. Such places would include locker rooms, bathrooms, changing rooms, swimming pool shower rooms, and so forth. To make matters worse in this case, the employees that are changing are not even aware that the camera is there, so they can't do anything to shield themselves from standing near it, because it catches the entrance of the locker room. If the camera were situated as to where it would not film ANY area that has a reasonable expectation of privacy, the court would find that the camera is not in violation of the law, but as it is now, it definitely is illegal.
